Case value is dependent on many factors. These include available coverage, extent of the injuries, and liability. Another very important factor is the reputation that your lawyers have for going to Court. At Catania & Catania all of our lawyers are trial attorneys with extensive courtroom experience. Insurance companies know which firms are willing to go to Court to get full value for your case and which take a quick settlement to avoid filing a lawsuit. At Catania & Catania we put families first and strive to always get full value for your claim.

Most of the time your medical bills will be paid in part by your PIP or No Fault coverage. Most policies provide $10,000 of coverage total and pay 80% of your bills. You may have additional coverage on your policy called Med Pay that will pay either more of your bills, a larger percentage of your bills, or both. You also may have a deductible on your policy that could lower the amount of available coverage. Another possible source of coverage would be any health insurance that you may have.

Most of the time the at fault driver will fix your car or pay you damages for your car if it is totaled out. If there is a liability dispute the at fault driver’s company may not be willing to pay full value for your car. If you have to pay a deductible we will include that in your claim against the at fault driver.

Unfortunately, the at fault driver usually does not voluntarily pay you for a rental car. The only way to usually get a rental car is through your own insurance company. You should look at your policy to see if you have renters coverage.

This is where something called underinsured or uninsured motorist coverage comes into play. If you have this coverage, called UM, then you will be covered for damages even if the at fault party did not have any insurance or did not have enough insurance to pay for your damages.

Usually it will take approximately 12-16 months to get the case resolved in a pre-suit setting. Of course many factors can affect this time frame such as the extent of your injuries, the extent of your treatment, any prior injuries that required treatment, liability or coverage disputes and just plain human factors like a difficult adjuster from the insurance company. If the case does not settle and goes to litigation we strive to get the case resolved within one year from the filing of the lawsuit. Again, many factors can influence this time frame that are out of our control such as the judge’s docket but this is a rough time frame that usually holds.
